Cross-Border Mediation
In cross-border disputes in which at least one of the parties has a residence or habitual abode in a Member State other than the Member State of residence or habitual abode of any of the other parties.

Advantages of Mediation
Mediation process is FAST
It takes much less time than court proceedings. The resolution of a conflict does not depend on a judge,but on the interests and preferences of the parties to the conflict.

Much less money is needed for mediation than for litigation.

It preserves the reputation of the parties to the dispute.
No one but you and a mediator knows what you shared during the mediation process.

About 80% of disputes subject to mediation end in agreements voluntarily implemented by the parties as they reach them through joint efforts and they are not imposed on them by a third party or court.

Fees
for Conducting Mediation and Consultation
The fees specified herein are in BGN and final, no VAT is charged on them according to Art. 113, para. 9 of the VAT Act.
All fees, except for the registration fee, are paid per astronomical hour.

Consultation Fee
Consultation fee for dispute resolution
- BGN 80 per hour.*
Registration fee
The registration fee is BGN 60. It is intended to cover the initial processing and exchange of documents and the contact with the parties to a dispute. It is paid together with the application for mediation.
The fee is not refundable if the other party does not agree to participate in mediation.
Mediation Fee
This fee is charged for a mediation session and includes 3 hours of mediation, preparation, and administration for conducting a scheduled procedure.
For disputes without material interest and with material interest of up to BGN 10,000, the fee is BGN 270 per session.
For disputes with material interest over BGN 10,000, the fee includes the session fee of BGN 270 + 1% of the material interest.
Additional hours after a 3-hour session are paid BGN 80 for disputes with no material interest and BGN 90 for disputes with material interest.**
Fee for Agreement Preparation
Mediation can end with a written agreement, which can be prepared by the mediator. The fee for preparation of a written agreement by the mediator is BGN 100.
*Fees are paid before the start of the services offered.
**Fees for complicated disputes, e.g. with more than two parties, complicated legal and factual situation, in cases of public interest and other specific cases are subject to individual negotiation. Should an agreement require more than 3 hours of mediation, the parties shall pay in advance the fee for the additional hours of mediation. No additional fees are charged for the participation of a second mediator. Fees are distributed equally between the parties, or are borne by the party that requested the mediation. Mediation fees are not linked to reaching an agreement or implementing it. Upon reaching an agreement, no additional remuneration is due. Fees paid are non-refundable. In case of mediation costs necessary, e.g. for translation, courier services, transport, hotel accommodation, hall rental, etc., such costs are approved and paid in advance by the parties. When conducting mediation in a language other than Bulgarian, an additional 30% is charged on the respective type of fee.
